Memo to those opposed to racial profiling: You can forget about the Fourth Amendment coming to your rescue. It’s gone…dead…distinguished away by lawyer/politicians like William Rehnquist and Warren Burger. We’re all to blame, but these guys were the kings.
What started as a war on street crime, continued as a war on drugs, and then as a war on terrorism gutted your protection against the government arbitrarily arresting you in violation of the Fourth Amendment. If I were Hispanic in Arizona, I’d try to get the hell out of Dodge. If you fit the profile, you’re going down.
It’s not just racial profiling that is legal now; all profiling is a legal basis to stop and detain you, then search you, and arrest you if probable cause develops.
We all thought this was great when used against street thugs, drug dealers or users, and perpetrators of senseless violence. Slippery slope, eh?
Dick the butcher, please…William Rehnquist, Warren Burger…Two Dead Lawyers. Oh, that’s right, they’re already gone, but their legacies will live on for decades.
